Regulations of the Marlu.pl online store

  1. Definitions
    1. Shop - MARLU online store available at: www.marlu.pl,
    2. Butik - Marlu boutique located at: ul. Żurawia 1a / Plac Trzech Krzyży 7, 00-503 Warsaw.
    3. Seller - the entity managing and running the Store, which is Marlu sp. z o.o. with its registered office in Warsaw (00-413) at ul. Ludna 9, entered in the register of entrepreneurs by the District Court for the Capital City of Warsaw. Warsaw, XII Commercial Department of the National Court Register under the number: 0000608287; REGON: 363999198; NIP: 7010559706.
    4. Regulations - this document with all attachments and additions that form an integral part of it.
    5. Buyer - anyone who purchases Products through the store.
    6. Product - a moveable item available in the Store, which is the subject of a sales contract between the Buyer and the Seller,
    7. User - any person who uses the Store, in particular to familiarise themselves with its offer or purchase Products.
  2. General Provisions
    1. The store sells women's clothing and MARLU accessories via the Internet.
    2. In order to place an order, select Products from the available offer, their colours, sizes and quantity by adding them to the "Basket".
    3. Until the selection of Products is approved with the "Place an order" button, the Customer has the option to make changes and modifications to the Products in the order, as well as contact details for delivery and billing.
    4. After the Buyer places the order, an appropriate confirmation will appear on the website, and a message containing information about the order will be sent to the e-mail address provided in the order. This message is a confirmation of the conclusion of the contract for the sale of Products, on the terms set out in these regulations.
  3. Orders
    1. Orders accepted for execution may be cancelled at the latest until the goods are shipped. Cancellation of the order is only done through the Boutique.
    2. Please be advised that the average order processing time (which means the period from the date of payment of the order to the date of shipment of the product) is 3 working days, except that in the absence of the product in stock, this time may be extended to 14 days, of which the Seller is obliged to notify the Buyer within 3 working days of placing the order.
    3. The order is processed after payment has been made or the requirements for the selected payment method have been met.
    4. If it is not possible to fulfil the order due to permanent unavailability of the Product, the Seller will notify the Buyer within 3 working days and within the next 3 working days will refund the entire amount of money received from him.
    5. If the customer chooses the method of payment by bank transfer or payment card, the order processing time is counted from the date of crediting the bank account or the Seller's settlement account.
  4. Payments
    1. Prices presented in the Online Store are gross prices (including VAT).
    2. A fiscal receipt is attached to each order by the Seller. A VAT invoice can be attached on request.
    3. The buyer making a purchase as an Entrepreneur for the purposes of his business declares that he is a VAT payer and authorises the Seller to issue a VAT invoice without the recipient's signature.
    4. The buyer chooses the form of payment when placing the Order:
      1. payment by traditional transfer to the Seller's account;
      2. online payment using the DotPay payment system;
      3. online payment using the Shoper payment system. The entity providing online payments in the field of fast transfer payments is Blue Media S.A.
      4. Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
    5. The deadline for making a deposit is 3 business days. After this deadline, the order may be cancelled.
    6. Along with the payment of the order, the Buyer makes a fee for its delivery, which is specified in the terms and costs of delivery.
    7. The Seller reserves the right to change the prices of Products presented on the Store's websites, post information about new goods, carry out and cancel promotional campaigns on the Store's websites, sales or make changes to them. The right of the Seller referred to in the previous sentence does not affect orders placed before the date of entry into force of the price change, conditions of promotional campaigns or sale. The Buyer will be informed by the Seller about the special conditions of promotional campaigns and sales. Promotions do not combine, unless the promotion regulations provide otherwise.
    8. If there is a need to return funds for a transaction made by the customer with a payment card, the seller will make a refund to the bank account assigned to the payment card of the Ordering Party.
  5. Delivery
    1. The choice of the method of collecting the shipment is made by the Buyer when placing an order in the Store.
    2. Delivery of Products is carried out by a courier company (DPD) or by the Polish post office. Shipping costs are borne by the Buyer in accordance with the current price lists.
    3. The buyer can pick up the Product in person at the Boutique.
    4. Current costs and delivery conditions can be found on the Store's websites in the tab: Delivery information.
    5. The buyer undertakes to collect the sent Product.
  6. Compeases for physical and legal defects
    1. Products offered in the Store are free from physical and legal defects. Products may become a two-year warranty, under which the Product can be repaired in terms of damage resulting from its normal use, in particular:
      1. completion of buttons/clasps/fasteners and other such elements or exchange for other agreed with the Buyer;
      2. undering or stitching torn elements of the Product;
      3. replacement of damaged elements of the Product with new ones the same or other agreed with the Customer, except that Marlu reserves the right to assess each time whether and what it is able to repair in a given Product. If the repair is not possible for reasons related to the fact that the damage caused is not related to the normal use of the Product, in accordance with the recommendations for washing and maintenance, Marlu has the right to refuse to perform repairs and to return the Product to the Customer at his expense. Marl also has the right to refuse repair if the repair turns out to be impossible due to the lack of materials or other finishing elements necessary to complete the repair.
    2. Information about the product warranty is included in the Product description on the Store's website and on the tag.
    3. In order to exercise the rights from the warranty, the Buyer delivers the Product to the Boutique with information about the scope of repairs and with a proof of purchase of the Product within a period of no more than 2 years before delivering the Product to the Boutique.
    4. Marlu undertakes to make repairs within the time agreed with the customer, except that no more than 14 days. If the repair of the Product requires the order of any materials or finishing elements, this date may be extended.
    5. The Buyer loses the right to submit a complaint if, before the expiry of one year from the discovery of the defect of the Product, but no later than before the expiry of 2 years from the release of the item to the Buyer, he will not notify the Seller.
    6. The advertised Product should be handed over to the Boutique no later than 7 days after submitting the complaint. The advertised Product should be accompanied by a receipt or a copy of it, possibly other proof that the Product was purchased from the Seller (e.g. VAT invoice, confirmation of payment by payment card, bank transfer, etc.). In the absence of such proof of purchase, the Seller has the right to refuse to accept the complaint and refund the price.
    7. The seller will recognise the complaint within 14 days of receiving the Product. If the Product has a defect, the Seller within the next 14 days, will make appropriate repairs, or replace the Product with a new one. After the ineffective expiry of the above-mentioned deadline, the Buyer has the right to return the defective item and request a refund of the price or request an appropriate discount (subject to point 6 sentence 2 above). If the new or repaired Product still has a defect, the Buyer may refuse further repairs or subsequent replacement of the Product and in this place may request an immediate refund of the entire price or a discount (subject to paragraph 6 sentence 2 above).
    8. The Seller may refuse to replace the Product with a new or repair a defective Product if the replacement of the Product or its repair is impossible or requires excessive costs compared to the method proposed by the Seller.
    9. The buyer cannot withdraw from the contract if the defect of the Product is irrelevant.
    10. Delivery of the advertised Product to the Seller takes place at the expense of the Buyer, but in the event that the complaint proves justified, the Seller will reimburse the delivery costs to the Buyer, on the basis of a bill or other proof of payment.
    11. Responsits to the complaint are given:
      1. in writing to the advertiser's address; or
      2. by e-mail to the e-mail address indicated by the advertiser.
  7. Right of withdrawal
    1. The consumer may withdraw from the contract for the purchase of the Product within 14 days from the date of receipt of the Product from the carrier or collection of the Product in the boutique (the date of sending counts). The statement of withdrawal is submitted on an electronic form available at https://marlu.pl/formularz-zwrotu/ . The statement of withdrawal may also be submitted in writing on the basis of the form constituting Appendix No. 2 to the Act on Consumer Rights of May 30, 2014. The day of withdrawal from the contract is considered to be the day of sending the form to the Seller.
    2. The condition for an effective withdrawal is to return the Product unchanged. The product must be returned within 14 days from the date of withdrawal. The costs of returning the product are borne by the Buyer.
    3. The buyer will refuse to refund the funds in the event that the returned Product has a damaged or broken security seal.
    4. The returned Product must be accompanied by a receipt or a copy of it, possibly other evidence that the Product was purchased from the Seller (e.g. VAT invoice, confirmation of payment by credit card, bank transfer, etc.). In the absence of such proof, the Seller has the right to refuse to accept the return.
    5. The price will be refunded within 10 working days from the date of receipt of the Product.
    6. Along with the price, the Seller will reimburse the Buyer for the costs incurred by him delivery costs, but in the amount corresponding to the price for standard delivery (mail) (possible deliveries via courier, in the "guarantees" mode or other higher shipping costs will not be refunded). If the Product was picked up in person at the Boutique, the Buyer only receives a refund for the Product.
  8. Final provisions
    1. In all matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act of 30 May 2014.
    2. All disputes arising from the functioning of the Store and the provision of services within the Store will be decided by the court competent for the seat of the Seller.
    3. The Seller reserves the right to make changes to the Regulations at any time. Changes to the Regulations are effective from the moment they are published on the Store's website. Amendments to the Regulations may not violate the acquired rights of Buyers and Store Users.
    4. The Seller takes measures to ensure the fully correct functioning of the Store's website, to the extent that it results from current technical knowledge and undertakes to immediately remove any irregularities reported by Buyers and other users. The store is not responsible for disruptions in the operation caused by a failure of the Internet network or other technical obstacles, which the Seller acting with due diligence could not previously eliminate.
    5. All photos, graphics, logos, publications and texts available in the Store are protected by the Act of February 4, 1994 on Copyright and Related Rights (Dz.U. 1994 No. 24 item. 83). It is forbidden to unlawfully copy, reproduce or distribute any content posted on the Store's website.
